Terms & Conditions

These Terms and Conditions ("Agreement") set out the rules that apply when you use the website of Provenance ("we", "us", "our") and when you engage any of our document organisation, succession education, or family archiving services. Please read them carefully. If any part is unclear, you are welcome to contact us before proceeding.

Our services are educational and organisational in nature only. Nothing in this Agreement, and nothing we do or say in the course of providing a service, constitutes legal advice, financial advice, valuation of assets, or professional representation of any kind. For matters requiring those services, we will always signpost you to the appropriate licensed professionals.

1. Definitions

In this Agreement, the following words have the meanings given below:

  • "Agreement" means these Terms and Conditions, together with our Privacy Policy and Cookie Policy.
  • "Service" means any of the educational workshops, document organisation sessions, or archiving programmes we provide.
  • "User" / "you" means any individual who visits our website or engages our services.
  • "We / Us / Our" means Provenance, operating from 64 Pattaya Beach Road, Bang Lamung, Chon Buri 20150, Thailand.
  • "Content" means all text, materials, workshop notes, guides, and other resources made available through our website or services.
  • "Session" means a scheduled appointment — in-person or remote — during which we assist with document organisation or deliver educational content.
  • "Records" means personal documents, files, or materials belonging to you or your family that you choose to bring to or discuss during a Session.

2. Acceptance of Terms

By submitting an enquiry, booking a Session, making a payment, or otherwise engaging our services, you confirm that:

  • You have read and understood this Agreement.
  • You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
  • If you are acting on behalf of another person or a family group, you have the authority to do so and accept these terms on their behalf.
  • You accept this Agreement as a whole, including the limitations on what our services cover.

3. Service Description

Provenance offers three services, described below. All services are strictly educational and organisational.

Service 1 · ฿3,800

Family Document Set-Up

A calm session to organise a family's own records into a clear, labelled archive. Filing and structure only; no valuation, no legal advice, no representation. The family keeps complete control of all original documents at all times.

Service 2 · ฿4,400

Succession Basics Workshop

A plain-language workshop explaining how estate-organisation and succession concepts generally work, the documents typically involved, and which official bodies and licensed professionals to approach for steps that require them. Educational only; no individual estate is reviewed during the workshop.

Service 3 · ฿27,000

Full Archive & Wishes Programme

A multi-session package helping families gather records, build an inventory, and write down personal wishes for safekeeping, with signposting to the proper official and licensed professionals. We organise and record; we never advise on values or entitlements.

All services are available primarily to persons resident in or visiting Thailand. Remote sessions may be arranged by mutual agreement. We reserve the right to decline or end a booking if we determine our services are not appropriate for a person's circumstances.

4. User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate and complete information when making an enquiry or booking.
  • Attend scheduled Sessions at the agreed time, or provide reasonable notice of cancellation (see Section 6).
  • Retain sole custody and responsibility for all original documents and records. We do not accept, store, or take custody of original documents.
  • Use our website and services only for lawful purposes consistent with this Agreement.
  • Not misrepresent the nature of our services to third parties or suggest we provide legal, financial, or professional advice.
  • Not record Sessions without our express written consent.
  • Treat our staff and premises with respect.

You agree not to use our services or website to: infringe any applicable law; upload or transmit harmful code; attempt to access systems or data without authorisation; engage in conduct that could harm Provenance or other users; or use educational content obtained through our services for any commercial resale purpose.

5. Intellectual Property

All Content on this website — including text, guides, workshop materials, layout, and design — is the intellectual property of Provenance or its licensors, unless otherwise stated. You are granted a limited, personal, non-exclusive, non-transferable licence to access and view that Content for your own private, non-commercial use only.

You may not copy, reproduce, distribute, publish, or commercially exploit any Content without our prior written permission. Workshop notes and printed materials provided during a Session are for your personal reference only and may not be shared commercially.

Your own documents and records remain your property at all times. By sharing them during a Session, you grant us no rights in them beyond what is necessary to deliver the agreed service.

6. Payment Terms

All fees are quoted and charged in Thai Baht (฿) inclusive of applicable taxes where required. Current service fees are:

  • Family Document Set-Up: ฿3,800
  • Succession Basics Workshop: ฿4,400
  • Full Archive & Wishes Programme: ฿27,000

Payment is due in full before or at the start of the first Session, unless we have agreed otherwise in writing. We accept cash (Thai Baht) and bank transfer. We do not accept payment by cheque.

Cancellation and refunds: If you cancel more than 48 hours before a scheduled Session, we will arrange a full refund or transfer to an alternative date at no extra charge. Cancellations within 48 hours may be subject to a ฿500 administration fee. If we cancel a Session for any reason on our side, you will receive a full refund or reschedule without charge. Refunds are processed within 14 business days.

We reserve the right to adjust fees for future bookings with reasonable notice. Confirmed bookings are charged at the fee agreed at the time of confirmation.

7. Service-Specific Terms

The following terms apply in addition to the general terms above:

  • Family Document Set-Up: The scope of each session is limited to organising and labelling the documents you bring. We do not assess the completeness of a document set or advise on what documents you ought to have.
  • Succession Basics Workshop: Content is general and educational. It reflects publicly available information about how Thai succession administration typically works and is not tailored to any individual's circumstances. Attendance does not create an adviser–client relationship.
  • Full Archive & Wishes Programme: Multi-session scheduling is agreed in advance. Any written "wishes" document produced is a personal record for your family's use and has no legal force in itself. We will signpost you to the appropriate licensed professionals — such as a notary or legal adviser — for any steps that require formal legal instruments.

8. Disclaimers

Our services and website Content are provided on an "as available" basis. To the fullest extent permitted by Thai law:

  • We make no representation that our general educational content is current, complete, or accurate in relation to any individual's specific circumstances.
  • We do not guarantee any particular outcome from using our services.
  • Nothing we say or provide constitutes legal advice, financial advice, taxation advice, valuation, or professional representation of any kind. For those matters, please consult a licensed professional.
  • We are not responsible for decisions you make based on information shared in our sessions or published on our website.
  • We do not verify the completeness or legal validity of any documents you bring to a session.

9. Limitation of Liability

To the fullest extent permitted by applicable Thai law, Provenance's total liability to you for any claim arising out of or connected with this Agreement or our services shall not exceed the total fees you paid for the specific service to which the claim relates.

We are not liable for: indirect or consequential loss; loss of profit or opportunity; loss of or damage to documents (original documents remain in your care at all times); decisions made by third parties such as government bodies, courts, or professionals; or events beyond our reasonable control.

Nothing in this Agreement limits our liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded under Thai law.

10. Indemnification

You agree to indemnify and hold harmless Provenance, its staff, and associates from and against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of this Agreement, your misuse of our services, or any false or misleading information you provide to us.

11. Termination

Either party may end a service engagement by giving written notice. If you terminate before a Session takes place, refunds are subject to the cancellation policy in Section 6. If we terminate because you have breached this Agreement, no refund obligation arises for work already performed.

Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Dispute Resolution) survive termination of this Agreement.

12. Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from or connected with this Agreement shall first be referred to informal resolution by contacting us at [email protected]. We will endeavour to respond within 10 business days.

If informal resolution is unsuccessful within 30 days, the dispute shall be submitted to mediation in accordance with the rules of the Thai Mediation Centre before any court proceedings are initiated, unless injunctive relief is urgently required.

The courts of Chon Buri Province, Thailand shall have exclusive jurisdiction over any dispute that proceeds to litigation.

13. General Provisions

  • Entire Agreement: This Agreement, together with our Privacy Policy and Cookie Policy, constitutes the entire agreement between you and us regarding our services, and supersedes any prior discussions.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right for the future.
  • Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign our obligations to a successor business without restriction.
  • Notices: Notices to us should be sent by email to [email protected] or in writing to 64 Pattaya Beach Road, Bang Lamung, Chon Buri 20150, Thailand.
  • Language: This Agreement is written in English. In the event of any translation, the English version prevails.

14. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, applicable law, or business practice. When we do, we will update the "Last Updated" date at the top of this page.

If the changes are significant, we will make reasonable efforts to bring them to your attention, for example by posting a notice on our website. Continuing to use our services or website after changes have taken effect means you accept the revised Terms.
